Thank you for choosing to be a part of our community at Berry Bites ("company", "we", "us", "our").These Terms and Conditions ("Terms") govern your use of the Berry Bites website (the "Site") and the purchase of products ("Products") offered on the Site. By accessing or using the Site and purchasing Products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase Products.

1. Ordering and Payment/Retainer Fee

1.1. By placing an order on the Site, you are making an offer to purchase the Products at the prices and terms specified on the Site.

1.2. All orders are subject to acceptance by Berry Bites. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspicion of fraudulent activity.

1.3. Prices for Products are subject to change without notice. The price charged for an order will be the price in effect at the time the order is placed.

1.4. The date of the event is considered “booked” upon receipt of a non-refundable deposit equalling 50% of the total value of the product and delivery charges (if needed), and a signed contract (invoice payment).

1.5. The final payment is due prior to pickup or delivery. If the Client fails to make payments, we reserve the rights to cease work, the order will be cancelled and no refund will be given.

2. Delivery

2.1. Berry Bites will deliver the Products to the address provided by you during the ordering process. You are responsible for providing accurate and complete delivery information.

2.2. While we strive to adhere to the estimated delivery times provided during your order placement, please understand that factors beyond our control, such as weather conditions, traffic, or unforeseen circumstances, may occasionally cause delays. While we cannot guarantee exact delivery times, we are committed to keeping you informed and making every effort to ensure timely delivery of your order.

3. Refunds and Changes to Order

3.1. The Client must notify us if there is a change in the date of the event or a complete cancellation. If a cancellation or rescheduling occurs 7 days prior to the date of the event, all money will be refunded minus the retainer fee.

3.2. If a cancellation or rescheduling occurs after 6 days prior to the event, 0% will be refunded including the non-refundable retainer fee.

3.3. Any changes must be submitted 7 days in advance. There will be no changes allowed 6 days prior to the event.

4. Designs

4.1. At Berry Bites, we take pride in crafting unique and beautiful designs for our products. While we strive to create original designs, please note that some designs may be inspired by existing concepts. We do not copy other designs outright but will endeavour to follow descriptions provided by customers as closely as possible, ensuring that each creation is tailored to meet your specific preferences.

4.2. Designs are agreed upon during the ordering process, and customers have the opportunity to review and confirm their chosen design before finalizing their order. If for any reason you are unhappy with the design of your order, we kindly ask that you notify us during the pick-up or delivery process. We will make every effort to address your concerns and make any necessary adjustments to ensure your satisfaction.

4.3. Please note that once the pick-up or delivery process is complete, we are not responsible for any dissatisfaction with the design of the product. It is the customer's responsibility to inspect the product upon receipt and communicate any concerns promptly.

5. Cakes Serving Sizes

5.1.Our standard serving size is approximately 1.5 inches wide by 2 inches long per portion. While we make every effort to provide accurate serving size estimations, please be aware that variations may occur during cutting. We cannot guarantee exact portion sizes due to factors such as cutting technique and individual preferences.

5.2. We are not responsible for any shortage of cake if portions are cut larger than our recommended serving size. It is the responsibility of the customer or event organizer to ensure that portions are cut appropriately to accommodate the desired number of servings.

6. Liability

6.1. Damages: Once your order has been picked up or delivered, Berry Bites will not be responsible for any damages that may occur. It is the customer's responsibility to handle the product with care and ensure its safe transportation and storage.

6.2. Allergies and Dietary Restrictions: While we take great care to accommodate allergies and dietary restrictions, please be aware that our facility is not nut-free. Allergy information and dietary restrictions are clearly stated at the time of ordering. Customers are responsible for reviewing this information and making informed decisions about their purchases.

Berry Bites Products may have come in contact with:

• Nuts

• Gluten

• Dairy

• Soy

Natural dyes, artificial flavourings, sugar, artificial sweeteners, artificial colour, and other allergens are not listed.

We may use “non-toxic” dust/decor to achieve desired design/colours. This may not be approved by FDA however it won’t cause harm if consumed in small amounts. 

We may also use alcohol to achieve desired design/colours. 

6.3.Edible Decorations: The majority of our decorations are edible. However, customers will be informed if there are any inedible decorations included. It is always recommended to remove all decorations before consuming the product to avoid any potential choking hazards or unintended consumption.

6.4. Consumer Safety: Berry Bites is committed to producing high-quality products, but we cannot guarantee against allergic reactions, choking hazards, or any other harm that may occur when consuming our products. Customers should exercise caution and discretion, especially when serving our products to individuals with known allergies or dietary restrictions.
